Terms of Service
Orchard is a game of chance played with real money on a public blockchain. Nothing here is an investment product, nothing is reversible, and most rounds end in a loss.

These Terms of Service (the “Terms”) govern your access to and use of the website at orchard.gold (the “Site”) and of the Orchard smart contracts deployed on Robinhood Chain (the “Contracts”, and together with the Site, the “Services”), operated by the operator of orchard.gold (“we”, “us”, “our”). By accessing or using the Services you (“you”) agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old, or the age of majority where you live, whichever is greater, and have the legal capacity to enter into these Terms.
1. The Services
The Contracts run a game in rounds of 75 seconds on a 25-plot field. You plant ETH; the entry swaps to AAPL inside your own transaction and that AAPL becomes your stake. One plot is drawn per round from the hash of a blockchain block committed to before that block exists; whoever planted on it splits the stake of the other plots, less a rake. The Site is an interface: it reads the Contracts and helps you send transactions to them. Anyone may use the Contracts without the Site.
The result of every round is determined by chance. No skill, timing or strategy makes a plot bloom.
The Services are permissionless and wallet-based. There is no registration and no account. You interact with the Contracts directly from your own wallet, and every transaction is recorded publicly and permanently on Robinhood Chain.
2. No affiliation with Apple or Robinhood
We are not affiliated with, endorsed by, sponsored by or connected to Apple Inc. or Robinhood Markets, Inc. or any of their group companies.
“AAPL” here means a tokenized equity issued by Robinhood on its own chain. We did not issue it and cannot control it. Holding it through the Services is not ownership of Apple shares and gives you no right against Apple, Robinhood, or any issuer. Names and marks are used only to identify the token in which the game is denominated. “SEED” is this project's own fixed-supply utility token: it carries no claim on any revenue, asset or entity, confers no ownership or governance right, and carries no promise of value.
3. Eligibility and your compliance
You may use the Services only where it is lawful for you to do so. Games of chance, tokenized securities and crypto-asset transactions are regulated differently in every country and are prohibited in some. Determining what applies to you is your responsibility, not ours, and we make no representation that the Services are lawful or available in your jurisdiction.
You represent, each time you use the Services, that:
- the funds you use are yours and lawfully obtained;
- you are not a person subject to sanctions, and you are not acting for one, and you are not located in a sanctioned territory;
- you will comply with the anti-money-laundering, counter-terrorist-financing, consumer, gambling and tax laws that apply to you.
Taxes on anything you win are yours to determine, report and pay. We withhold nothing and give no tax advice.
4. Non-custodial; finality; fees
You hold your own keys. We never take custody of your funds, cannot sign on your behalf, and cannot move, freeze or recover anything in your wallet. Securing your wallet, keys, recovery phrase and devices is yours alone; loss through a compromised wallet, a phishing site or your own error is not recoverable by us or by anyone.
All transactions are final. There is no refund, chargeback, cancellation or reversal — not for a mistyped amount, a plot you did not intend, a round you lost, or funds sent to the wrong address.
Transactions settle on-chain in ETH and AAPL. Network fees are yours to pay. The price your entry receives is whatever the market gives at the moment it executes, bounded only by the minimum-output figure your own transaction carries.
5. Operation of the Contracts
The Contracts are immutable, but they are operated rather than autonomous, and you should not treat them as trustless. The owner may adjust bounded parameters — the rake, the admin fee, the jackpot share and odds, and the minimum plant — and may direct the game to a different randomness or swap module. Each change emits an on-chain event, and the economic parameters of a round are frozen when that round seals, so a change never re-prices a round already in flight.
The owner cannot reach staked funds, unclaimed winnings or the jackpot, and ownership cannot be renounced. Withdrawals available to the owner are limited to the treasury share of the rake and the admin fee. Current values are shown on the About page and are readable on-chain at any time.
6. Acceptable use
Automated play is permitted. The rules an agent needs are published at skill.md — a bot planting by those rules is a player like any other.
You agree not to:
- attack, overload, probe or attempt to exploit the Site, the Contracts or the infrastructure behind them;
- interfere with other players, impersonate anyone, or misrepresent your identity or affiliation;
- transmit malware or harmful code through any surface we provide;
- use the Services to launder funds, finance terrorism, evade sanctions, or commit any other offence;
- infringe our intellectual property or anyone else's.
The Site, its text and its artwork are ours. The Contracts are open and the protocol is yours to build on.
7. Risks you accept
- You will usually lose the round. One plot in twenty-five blooms. Plant only what you can afford to lose entirely.
- The issuer controls AAPL. Robinhood can pause transfers, block addresses, burn balances held by any address, and replace the token implementation — including balances held by the Contracts. Nothing in the game can prevent this.
- Volatility. AAPL and SEED can lose value sharply and without warning.
- Smart-contract risk. The Contracts are tested, not proven correct. A defect can cause permanent loss.
- Chain risk. Robinhood Chain runs on a single sequencer. If it halts, censors or reorders transactions the game halts with it, and that same sequencer produces the blocks from which the draw is read.
- Regulatory risk. Rules governing tokenized securities and games of chance are unsettled and may restrict or end the Services.
- Third-party risk. Wallets, node providers, exchanges and liquidity pools are outside our control.
8. Disclaimers
The Services are provided “as is” and “as available”, without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Nothing in the Services is financial, investment, legal or tax advice, an offer or solicitation to buy or sell any security, or a promise of reward, profit or return. Figures displayed are read from the chain and may be delayed, incomplete, wrong or unavailable. We do not warrant that the Site will be uninterrupted or error-free.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost funds, lost profits, lost data or lost opportunity, arising out of or in connection with the Services — including failed or delayed transactions, defects in the Contracts, chain or sequencer outages, and any action taken by the issuer of AAPL.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for death or personal injury caused by negligence, and any mandatory rights you have as a consumer under the law of your country of residence. Where such rights apply, they prevail over anything inconsistent here.
10. Indemnity
You agree to indemnify and hold us harmless against claims, losses, liabilities and reasonable costs (including legal fees) arising from your use of the Services, your breach of these Terms, or your infringement of the rights of a third party. This does not apply to the extent the claim results from our own fraud or wilful misconduct.
11. Suspension, termination and force majeure
We may suspend, restrict or end access to the Site, in whole or for any person, at any time and without notice, and may change or discontinue it entirely. The Contracts keep running whether or not the Site does; ending your access to the Site does not take anything from your wallet.
We are not liable for failure or delay caused by events beyond our reasonable control, including blockchain or sequencer outages, network or infrastructure failure, cyberattack, acts of government or regulators, and natural disaster.
Sections 7 to 10, and any other clause intended to survive, remain in force after your access ends.
12. General
If a provision of these Terms is found unenforceable, the rest remains in force and the provision is applied to the greatest extent permitted. Our failure to enforce a provision is not a waiver of it. We may assign these Terms as part of a transfer of the project; you may not assign yours. These Terms, with the Privacy Policy, are the entire agreement between us about the Services. The English text governs; a translation is offered for convenience only.
If these Terms change, the revised version appears on this page with a new effective date, and continuing to use the Services means the new version applies to you.
